1. Introduction

NIN9 Studios ("the Studio", "we", "us", "our") is a professional photography and videography studio registered in the Republic of Singapore. We take the protection of our creative work seriously.

This Copyright & Intellectual Property Policy ("Policy") sets out the ownership, licensing, and permitted use of all creative works produced by NIN9 Studios, including works commissioned by clients and content published on our website at www.nin9studios.com.

By engaging our services, accessing our website, or using any content produced by us, you ("the Client", "the User", "you") acknowledge and agree to be bound by the terms of this Policy. This Policy should be read together with our Client Service Agreement, Terms and Conditions, and Privacy Policy.

2. Ownership of Copyright

In accordance with the Copyright Act 2021 of Singapore, NIN9 Studios retains full and exclusive copyright and all other intellectual property rights in all works we create, including but not limited to:

  • Photographs (edited and unedited, including raw files)
  • Videos, motion graphics, and audiovisual content
  • Written content, captions, and copywriting
  • Website design, layout, graphics, and user interface elements
  • Branding assets, logos, and visual identity materials
  • Behind-the-scenes content, outtakes, and derivative works

Payment of fees by a Client does not transfer copyright ownership to the Client. Payment grants the Client a license to use the delivered work within the scope and tier agreed in writing, as described in Section 3. Any transfer of copyright must be documented in a separate written assignment, signed by an authorised representative of the Studio.

3. Client License Tiers

Clients commissioning work from NIN9 Studios are granted a non-exclusive, non-transferable license to use the delivered files, limited to the tier purchased and documented in the Client Service Agreement or quotation. The available tiers are:

3.1 Personal Use Only

The Client may use the delivered files for personal purposes such as private printing, gifting to family and friends, and private display within the home. Commercial use, public distribution, and use on business or brand-affiliated channels are not permitted.

3.2 Personal + Social Media

The Client may use the delivered files for personal purposes (as described in 3.1) and may publish them on their own personal social media accounts, provided the files are not used for commercial promotion, paid advertising, or third-party commercial benefit.

3.3 Commercial Use

The Client may use the delivered files for business marketing, their official website, social media channels, advertising campaigns, printed collateral, and public relations materials, strictly within the scope and duration agreed. Resale, sub-licensing, and transfer to third parties are not permitted without the Studio's prior written consent.

3.4 Custom Scope

Where a Client requires usage rights beyond the standard tiers above (such as broadcast rights, stock licensing, extended territorial rights, or exclusive use), these must be negotiated separately and documented in writing before delivery.

All licenses are personal to the Client named in the engagement and may not be assigned, sold, or transferred without the Studio's prior written consent.

4. Prohibited Uses

Regardless of the license tier purchased, the following uses are strictly prohibited unless the Studio has given prior written consent:

  • Reselling, re-licensing, or redistributing the delivered files, in whole or in part, to any third party.
  • Transferring the files, or any rights in the files, to another individual, business, or entity.
  • Using the files for any commercial purpose beyond the scope of the license granted.
  • Materially altering, editing, filtering, cropping, overlaying, or otherwise modifying the delivered files in a way that changes the creative integrity of the work.
  • Removing, obscuring, or tampering with any watermark, signature, metadata, or credit embedded in the files.
  • Submitting the delivered files to competitions, awards, or publications as the Client's own creative work.
  • Using the delivered files, or any part of them, as training data or input material for artificial intelligence, machine learning, generative models, or any automated content generation system.
  • Reverse-engineering, decompiling, or extracting proprietary elements from any digital deliverable or website asset.

Breach of any of the above constitutes copyright infringement and will be pursued to the fullest extent of Singapore law.

5. Protection of Website Content

All content published on www.nin9studios.com, including photographs, videos, written text, graphics, layouts, source code, and design elements, is the exclusive property of NIN9 Studios and is protected under the Copyright Act 2021 of Singapore and applicable international copyright treaties.

5.1 Technical Deterrents

The Studio employs technical measures on its website, including (but not limited to) right-click disabling, image hotlink prevention, and watermarking. These measures are deterrents only and do not constitute a waiver of copyright, nor do they imply that content without such measures is free to use. The absence of a technical restriction does not grant any permission to copy, download, or reuse content.

5.2 Prohibited Website Activities

The following activities in relation to our website are strictly prohibited:

  • Downloading, saving, screenshotting, or reproducing images, videos, or other content for any purpose beyond private, non-commercial viewing.
  • Scraping, crawling, data mining, or using automated tools to extract content from the website.
  • Framing, mirroring, or embedding our content on third-party websites or applications without written consent.
  • Removing or altering copyright notices, watermarks, or metadata.
  • Using any content from the website to train, fine-tune, or develop artificial intelligence or machine learning systems.

5.3 Enforcement

Unauthorised reproduction, scraping, or redistribution of website content will result in legal action, which may include injunctive relief, claims for damages, account of profits, and recovery of legal costs under the Copyright Act 2021 of Singapore.

6. Attribution & Credit

Where delivered files or website content are shared publicly under a permitted license, the Client or User is encouraged to credit NIN9 Studios by tagging @nin9studios on social media or including the credit "Photography/Videography by NIN9 Studios" where appropriate.

Watermarks, signatures, and embedded credits must not be removed, cropped, or obscured. The Studio also reserves the right to use delivered works in its own portfolio, website, social media, marketing materials, exhibitions, and competitions, as set out in the Client Service Agreement.

7. Third-Party Permission Requests

Third parties wishing to license, reproduce, feature, or otherwise use any NIN9 Studios work (whether commissioned client work or website content) must submit a formal written request to admin@nin9studios.com before any use.

Each request must include the following:

  • Full name and contact details of the requesting party.
  • Name of the organisation or publication, if applicable.
  • Identification of the specific work(s) requested (title, URL, or description).
  • Intended purpose and context of use.
  • Distribution medium (print, digital, broadcast, social media, etc.).
  • Territory of use.
  • Duration of use.
  • Whether the use is commercial or non-commercial.

The Studio will respond to permission requests within seven (7) to fourteen (14) business days. Permission is at the sole discretion of the Studio and may be subject to a licensing fee, attribution requirements, and other conditions set out in a written license agreement.

Important: Unauthorised use of our work is not retrospectively legitimised by a subsequent permission request. The Studio reserves the right to pursue legal action for any use that occurred prior to written authorisation.

8. Enforcement & Legal Action

NIN9 Studios actively monitors the use of its creative works and will enforce its intellectual property rights to the fullest extent permitted by law.

In the event of any infringement, the Studio reserves the right to:

  • Issue formal cease-and-desist notices to the infringing party.
  • Submit takedown notices to internet service providers, social media platforms, hosting providers, and search engines (including under the applicable notice-and-takedown procedures of jurisdictions outside Singapore).
  • Commence civil proceedings in the courts of the Republic of Singapore under the Copyright Act 2021, seeking remedies including but not limited to injunctive relief, statutory and actual damages, account of profits, delivery-up of infringing material, and recovery of legal costs.
  • Report the infringement to relevant law enforcement authorities where criminal copyright infringement is suspected.

The Client and any third-party User acknowledges that unauthorised use of the Studio's works may cause significant commercial and reputational harm, and agrees that monetary damages alone may not be an adequate remedy. The Studio shall accordingly be entitled to seek equitable relief, including injunctions, without the requirement to post security.

9. Changes to This Policy

NIN9 Studios reserves the right to amend, update, or replace this Policy at any time, in its sole discretion. The current version will always be published at www.nin9studios.com with the "Last Updated" date clearly indicated.

Continued use of our website or engagement of our services following any update constitutes acceptance of the revised Policy. Clients with active engagements will remain subject to the version of the Policy in force at the time their Client Service Agreement was signed, unless otherwise agreed in writing.

10. Governing Law & Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts of the Republic of Singapore.
